Is surrogacy legal in mainland China?
No. Surrogacy is banned outright in mainland China, both commercial and altruistic. Is surrogacy legal in Hong Kong?

Who is eligible for IVF or egg freezing in Hong Kong?
Access is comparatively restrictive: only married couples can access IVF services, the woman must be under 40, no more than three embryos can be transferred per cycle, and sex selection is prohibited except to prevent a serious sex-linked genetic disease. Because same-sex marriage isn't legally recognized in Hong Kong, same-sex couples and single women are currently unable to access post-egg-freezing services leading to a live pregnancy, even where egg freezing itself was performed.
What about fertility treatment access in mainland China?
Mainland China's framework is generally more restrictive still. IVF access has historically required a marriage certificate, and donor sperm is only available through a small number of licensed public sperm banks — donor eggs are heavily restricted and effectively unavailable through regulated channels for most patients. This combination of restrictions is a major reason patients from mainland China travel to Hong Kong or abroad for treatment, and correspondingly a major reason shipping reproductive material into or out of mainland China comes up as often as it does.
Is shipping to or from Hong Kong more straightforward?
Generally, yes, from a pure customs-and-logistics standpoint — Hong Kong functions as a major international logistics hub with well-established procedures for handling biological material shipments, and doesn't carry the same quarantine-approval regime that mainland China applies.
That said, Hong Kong's own reproductive-treatment eligibility rules (married couples only, age limits, gamete-source restrictions) still apply once your material arrives — customs clearance and clinical eligibility are two separate questions, and clearing customs doesn't mean a Hong Kong clinic can necessarily use your material for your intended treatment plan.
