Nigeria is West Africa's most active surrogacy destination and one of the most established on the continent. Its fertility sector has grown rapidly, particularly in Lagos and Abuja, driven by strong domestic demand and a growing international client base from the UK, USA, and the African diaspora.

The legal picture: Surrogacy in Nigeria is neither explicitly legal nor illegal. Arrangements operate under private contract law, and the quality of your legal protection depends entirely on the expertise of your legal team. A Surrogacy Regulatory Commission Bill has been in development, and the landscape continues to evolve — making experienced legal coordination non-negotiable.

Who can pursue surrogacy in Nigeria: Heterosexual couples and single parents. Same-sex couples face significant legal and cultural barriers and should seek confidential advice before making any decisions.

Why Nigeria works: Cost-effectiveness, a large and growing network of IVF clinics, and relatively quick surrogate matching times make Nigeria a compelling option — particularly for the African diaspora and for UK and US parents comfortable operating within a contract-law framework with strong legal support.



2. Ghana — West Africa's Most Legally Structured Destination

Legal status: Formally recognised under Act 1027 (2020); Pre-Birth Parental Order available Open to international parents: Yes Costs: $30,000 – $58,000 USD

Ghana stands out among African surrogacy destinations for one important reason: it has a formal legal framework. Section 22 of the Registration of Births and Deaths Act, 2020 (Act 1027) formally recognises surrogacy and introduces the Pre-Birth Parental Order — a High Court order that names the intended parents as the child's legal parents before birth.

The legal picture: Intended parents can apply for a Pre-Birth Parental Order within 12 weeks of embryo transfer, with the birth required to occur within 28 weeks of the order being granted. These are strict, non-extendable deadlines. If missed, the surrogate is registered as the mother at birth, and a significantly more complex post-birth process follows. A dedicated Assisted Reproductive Technologies Bill is expected to further strengthen the framework.

Who can pursue surrogacy in Ghana: Heterosexual couples and single parents. Ghana does not legally recognise same-sex relationships.

Why Ghana works: The formal legal framework, English as the official language, Ghana's political stability, and the availability of Pre-Birth Parental Orders make Ghana one of the most attractive destinations for international parents who prioritise legal certainty. 3. Kenya — East Africa's Established Surrogacy Hub

Kenya is East Africa's most active surrogacy destination, with Nairobi home to several established fertility clinics and a well-developed network of surrogacy professionals. It has long served international parents — particularly from the UK, USA, Ireland, and Europe — and continues to attract significant international interest.

The legal picture: Kenya operates in a legal grey area. There is no dedicated surrogacy statute, though arrangements function under contract law. Two important developments shape the current landscape: under existing Kenyan law, the surrogate is the legal mother at birth, requiring intended parents to obtain a court order to establish legal parenthood; and Kenya's Parliament passed an Assisted Reproductive Technology Bill in November 2025, which — when enacted — will introduce formal regulation including altruistic-only surrogacy and automatic transfer of parental responsibility at birth. Kenya's 2019 ban on inter-country adoptions adds additional complexity for foreign nationals.

Who can pursue surrogacy in Kenya: Heterosexual couples and single parents. Kenya criminalises same-sex relationships.

Uganda is an emerging surrogacy destination that has attracted growing international attention, particularly as an affordable East African alternative to Kenya. Kampala has a developing network of fertility clinics, and surrogacy arrangements operate on a contractual basis in the absence of dedicated legislation.

The legal picture: Uganda has no specific law governing surrogacy. Arrangements are treated as private contracts, with no dedicated legal framework for parental rights, surrogate protections, or birth registration. This is the most legally unstructured of the five destinations covered in this guide — which means the quality of your legal support and the robustness of your contract carry even greater weight than elsewhere.

Who can pursue surrogacy in Uganda: Heterosexual couples and single parents. Uganda does not support same-sex relationships.

Why Uganda works for some parents: Lower cost than Kenya and Ghana, and growing availability of fertility services make Uganda appealing for parents who are cost-conscious and comfortable working in an unregulated environment with strong legal and coordination support. It is not the right destination for those who prioritise legal certainty above all else.


5. South Africa — Africa's Most Regulated Framework

South Africa has the most mature and formally regulated surrogacy framework on the African continent. Surrogacy is governed by Chapter 19 of the Children's Act, which requires mandatory High Court confirmation of the surrogacy agreement before conception. Commercial surrogacy is criminalised — all arrangements must be altruistic.

The legal picture: South Africa's framework is robust and well-tested. Intended parents are legally recognised as the child's parents from birth following court confirmation. The surrogate has no parental rights once the agreement is confirmed. However, the domicile requirement — at least one intended parent must be domiciled in South Africa — significantly limits accessibility for purely international parents.

Who can pursue surrogacy in South Africa: Heterosexual couples and, within the domestic framework, same-sex couples. The domicile requirement is a significant barrier for most international intended parents who are not resident in South Africa.

Why South Africa works for the right parents: For intended parents with a genuine South African domicile — including South African diaspora living abroad who maintain domicile — the framework offers the strongest legal protection of any African destination.
